Terms of Service

These Terms of Service ("Terms") govern your use of Pinnacle, a product of Pinnacle Fi, Inc. ("Pinnacle," "we," "us"). By using Pinnacle you agree to these Terms.
Not financial advice
Pinnacle is an informational and educational tool. It does not provide financial advice. We are not a registered investment adviser, broker-dealer, or financial planner, and we are not registered with the SEC, FINRA, or any comparable regulator in any jurisdiction. Nothing Pinnacle produces is a recommendation to buy or sell any security, cryptocurrency, or other asset.
This applies to everything the service outputs, without exception: Orion's scores, recommendations and monthly ideas; investment theses; price, anomaly and custom alerts; risk analysis and risk-tolerance framing; sector and rotation analysis; portfolio exports and tax-loss-harvesting output. None of it is personalised advice, none of it is tax, legal, or accounting advice, and none of it accounts for your individual circumstances, objectives, or needs — even where you have told us your risk tolerance or we have analysed your holdings. Information you give us tunes what the software shows you; it does not make the output advice.
Orion's analysis is generated by an AI system and may be incomplete, out of date, or simply wrong. Market data comes from third parties and may be delayed or inaccurate. You are solely responsible for your own investment decisions, and you should consider consulting a licensed professional before acting on anything you see here. All investing involves risk, including the possible loss of principal. Past performance does not predict future results.
No execution of trades or custody of assets
Pinnacle does not execute trades, hold or custody your assets, or place orders on your behalf. It is an informational and analytical tool only.
Pinnacle can optionally connect to a cryptocurrency exchange account that you link, using read-only credentials that you supply, for the sole purpose of importing your balances so they appear in your portfolio. That connection cannot trade, transfer, or withdraw, and you can unlink it at any time. You are responsible for issuing credentials with read-only permissions, and for any consequence of providing credentials with broader permissions than Pinnacle requires.
Accounts
You are responsible for keeping your account credentials secure and for all activity under your account. You may delete your account at any time from within the app; see our Privacy Policy for what deletion removes. We may suspend or terminate an account that breaches these Terms.
Age requirement
You must be at least 13 years old to use Pinnacle. Pinnacle is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we hold data from a child under 13, we will delete it — contact privacy@pinnaclefi.app to report this.
If you are under 18 (or under the age of majority where you live), you may use Pinnacle only with the consent and supervision of a parent or legal guardian. That parent or guardian is responsible for your use of the service, including any subscription purchased through your account. If you are a parent or guardian and you become aware that your child is using Pinnacle without your consent, contact us and we will act on your instructions.
Some jurisdictions set a higher minimum age for consenting to data processing without the authorisation of a parent or legal guardian (16 in parts of the EEA). Where that applies to you, that higher age governs.
Subscriptions and cancellation
Pinnacle offers a free tier and paid subscriptions (Pro and Premium). Paid plans are billed through our payment provider on a recurring basis, in advance, and renew automatically until cancelled. Prices are shown in the app and may change with notice.
You can cancel at any time from within the app. We may from time to time offer an alternative to cancelling, such as a discount or a temporary pause of billing; accepting one is entirely optional and declining it never prevents you from cancelling.
What happens when you cancel depends on your plan. On a monthly plan — and on an annual plan cancelled late in its term — cancellation takes effect at the end of the current billing period: your paid features remain available until then, you are not billed again, and no refund is due because you keep the access you already paid for. On an annual plan cancelled earlier in its term, we refund the unused portion of your year and your paid access ends at the close of the last month you were actually charged for — earlier than the full year you prepaid.
Apart from that pro-rated annual refund, and except where a refund is required by law, payments already made are non-refundable. If a paid feature is unavailable for a sustained period, contact us and we will make it right.
If your subscription lapses or you downgrade, data you entered while on a paid plan is retained, but features limited to a paid tier stop working until you resubscribe.
Acceptable use
Don't misuse Pinnacle: no attempting to breach security, scrape data at scale, reverse-engineer the service, resell or redistribute the market data or analysis it provides, or use it for any unlawful purpose. Automated access is permitted only through a developer API key we have issued to you, within any published limits.
Your content
The holdings, notes, and other information you enter remain yours. You grant us only the permission needed to operate the service for you — to store your data, display it back to you, and process it (including through the third-party providers described in our Privacy Policy) to generate the analysis and alerts you request.
Changes to the service and to these Terms
Pinnacle is under active development. We may add, change, or remove features. If we make a material change to these Terms we will update this page and revise the "last updated" date above; continued use after an update constitutes acceptance of the revised Terms.
Disclaimers & limitation of liability
Pinnacle is provided "as is," without warranties of any kind. Market data comes from third parties and may be delayed or inaccurate. To the fullest extent permitted by law, Pinnacle Fi, Inc. is not liable for any losses or damages arising from your use of the app or reliance on any information or idea it provides.
Governing law and jurisdiction
These Terms and any dispute arising out of them or your use of Pinnacle are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Pinnacle Fi, Inc. agree that the state and federal courts located in the State of Delaware have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue in those courts.
Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the country where you live, or of the right to bring proceedings in your local courts where that law gives you that right.
Severability
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force.
